案例某市土地储备中心以其所收购储备的一宗面积为20000平方米的土地,向当地土地登记机构提出国有土地使用权登记申请,并打算以此使用权进行抵押。该市土地登记机构以该宗储备土地有重新主张土地使用权人,其产权存在争议为由,不予办理登记。而土地储备中心认为其享有储备期间土地的国有土地使用权,对土地登记机构不予登记的行为向法院提起行政诉讼,要求为其储备土地办理国有土地使用权登记。
Case A land reserve center in a certain city filed an application for registration of the state-owned land use right with the local land registration agency for an area of 20,000 square meters which it purchased and planned to use the right to mortgage. The land registration agency in the city reserves the right to use land for those who have re-asserted the land, and the property rights of the land are not subject to registration due to the dispute. However, the Land Reserve Center considers that it has the right to use the state-owned land of the land during the reserve period and lodges an administrative lawsuit in the court for the non-registration of the land registration agency, requesting that the state-owned land use right registration be conducted for the reserved land.
