自从2007年以来,在房地产领域出现了一个让国人不得不关注的话题,那就是小产权房的产权是否具有合法性。针对这一现象,很多学者参与了讨论,提出了一些有价值的观点,但是很遗憾没有多少人从法理学的角度对其进行深入的理论分析。本文试图借用当代西方马克思法学流派的代表人物哈贝马斯的交往行为理论作为分析工具,分四个部分对这一社会热点问题进行理论分析。
Since 2007, in the field of real estate there has been a topic that people have to pay attention to, that is, the property rights of small property houses are legitimate. In response to this phenomenon, many scholars participated in the discussion and put forward some valuable ideas, but unfortunately not many people from the jurisprudence point of view of its in-depth theoretical analysis. This thesis attempts to use the theory of communicative action of Habermas, a representative of contemporary Western Marxist jurisprudence, as an analytical tool to analyze the hot issues of this society in four parts.
