《物权法》第158条对地役权的设立既已采登记对抗主义规则,第169条关于已登记地役权的变更和转让应及时办理变更登记的规定,也应解释为登记对抗主义规则。已登记地役权因当事人的意思表示而提前消灭的,应采登记对抗主义规则;因供役地灭失等事实行为而消灭的,应采登记宣示主义规则。
Article 158 of the Property Law provides for the enactment of antitrust rules on the establishment of easements. Article 169 of the Regulations on the alteration and transfer of registered easements should promptly handle the change registration and should also be interpreted as registration of antagonistic rules. The registered easement must be enrolled in the registered easement due to the intention of the parties, and the rules of enlightened declaration should be adopted if the servitude is extinguished due to factual acts such as the loss of the place of service.
