从执法正当性的立法保障机制来看,应当以交往理性的视角倡导广大民众加入行政立法之中。从执法正当性的审查保障机制来看,应当确定行政执法正当性的审查监督范围、加强国家有关机关对行政执法活动的法律监督,强调高效合理的原则。从执法正当性的错误纠正机制来看,应当以司法纠错和行政纠错为主要手段。
Judging from the legislative guarantee mechanism of the legitimacy of law enforcement, we should advocate the general public to join the administrative legislation from the perspective of communicative rationality. Judging from the review and guarantee mechanism for the legitimacy of law enforcement, it is necessary to determine the scope of examination and supervision of the legitimacy of administrative law enforcement, strengthen the legal supervision over the administrative law enforcement activities by the relevant state agencies, and emphasize the principle of high efficiency and reasonableness. From the error correction mechanism of the legitimacy of law enforcement, judiciary error correction and administrative error correction should be the main means.
