权力清单是对现行法律法规规章中关于行政权限的梳理、整合、归纳、重新配置等。通过权力清单,可以有效规范和控制行政权力,促进政府依法行政。目前,权力清单制定中存在着各自为政、一哄而上的现象,导致权力清单内容结构不统一、权力名称烦琐、权限差异大、少数质量不高等问题。作为以法律法规规章为依据的权力清单制度,必须进行顶层设计,将权力清单制度的推行与相关法律法规规章及规范性文件的废改行为相结合,并由国务院及其部委对权力清单内容、结构、名称、监督、运行平台等进行整体设计,各省、市予以配合,形成上下联动协调的权力清单体系。
The list of powers is to sort out, integrate, summarize and re-arrange administrative powers in the existing laws and regulations. Through the power list, we can effectively regulate and control administrative power and promote the government’s administration according to law. At present, there are various acts of self-determination and mass actions in the formulation of the power list, resulting in inconsistencies in the contents of the power list, cumbersome power names, large differences in competence, and a small number of inferior qualities. As a system of power lists based on laws, regulations and rules, the top-level design must be carried out. The implementation of the power list system should be combined with the relevant laws, regulations and rules and the abolition of regulatory documents. The State Council and its ministries should review the power list, Structure, name, supervision, operation platform and other overall design, the provinces and municipalities to cooperate with each other to form a coordinated power system from top to bottom.
