日前,上海浦东新区法院针对一起“在广告宣传的款式描述中使用他人商标”的商标侵权案作出判决。该案中,原告卡地亚公司拥有在首饰、宝石等商品类别上的“Cartier”、“卡地亚”商标专用权。而被告梦克拉公司生产珠宝首饰商品,在网络上开设网店进行销售,商品信息中有“18K钻石戒指Cartier款百年经典皇冠钻戒”、“品牌梦克拉”、“设计风格源自百年经典Cartier(卡地亚)”等内容。据此,卡地亚公司以被告的上述行为使消费者产生混淆,严重损害了原告的合法权
