在牧区中,与牧民生活息息相关最重要的就是草场。随着经济社会的不断发展,现在牧户们对于在草原上进行各种开发有了一定认识,但对于草原上矿产资源开发的认识停留在国家需要这一层次,很多情况下对生态补偿费用不满意,即便对补偿达成统一认识后很多补偿费用也不能及时落实到位。草场与牧民的生活息息相关,牧民对草场的关注受到重视。追究其原因,法律不健全各方权责没有明确化,监管不到位占有很大一部分原因。具体表现在,第一、的草原矿场资源开发征收补偿到现在为止都没有一部全国性完整的法律规范,也没有与配套的法律法规形成有规范性具体的法律制度体系。第二、对各方利益相关者人的权利、义务、责任没有全面的界定,仅用原则来规定有关补偿的内容、标准、给付方式等,形成了现在强制性补偿占有一小部分,资源性补偿要求占绝大多数的实际情况。现实中的实际情况导致利益相关者无法根据法律规定来明确负有权利与该承担的责任。立法层面的不完善导致现在民族区域自治地方矿场资源受偿主体的不明确性,这些需要我们从自发层面不断去完善。
