在刑事附带民事诉讼中,民事诉讼部分的提起和赔偿范围一直是颇有争议的问题,特别是与现行的《民事诉讼法》不能协调一致,也多被学者所诟病。文章联系司法实践,结合我国的《刑法》、《民法通则》、《民事诉讼法》的有关内容和立法精神,就附带民事诉讼提起的期间、提起的方式以及赔偿范围是否应包括精神损害等争议较大的问题进行了探讨,对未来刑事附带民事诉讼立法提出了见解。
