网络技术和计算机技术的发展及其广泛应用,促进了现代人的工作、生活方式和思想观念的改变。网络的实时性、互动性、跨地域性以及无间断性,使得传统的交易方式和工作方式发生了根本的改变。而由于网络本身存在的虚拟性和匿名性,其存在和发展也对我们的立法和司法以及行政执法提出了新的问题。在各主要国家和地区的专利制度中,现有技术是影响到一项发明或者实用新型是否具有新颖性和创造性的关键,现有设计也是影响到外观设计是否能够得到授权以及在无效宣告程序中得以维持的关键之所在,而判断现有技术和现有设计的法定标准就是公开时间。在2008年12月27日通过的《专利法》修正案之中,现有技术和现有设计的范围都得以拓宽,即包括了申请日(有优先权的,指优先权日)之前国内外出版物公开、使用公开以及其他方式公开的所有技术和设计。由此,网络公开的现有技术和现有设计的判断必将变得更加复杂。专利无效宣告案件是一类由专利复审委员会主管的特殊行政裁决案件。在该类案件中,虽然有双方当事人参加并且大多数案件都要通过庭审结案,但是从各国的立法来看,无效宣告制度又担负着提高专利授权质量、防止不当授予的专利权对自由竞争的消极影响和对技术进步的不当阻碍等功能,因此在价值和功能上又不同于普通的民事争议解决程序。基于此,本卷的疑案会诊遴选了专利制度中专利无效宣告及司法审查程序中的疑难案件,提出了网络公开证据的真实性如何认定、举证责任如何分配以及公开时间如何确定的问题。欢迎读者诸君各抒己见,热烈研讨。
