在我国,与产品责任相关的法律规范有《中华人民共和国民法通则》与《中华人民共和国侵权责任法》等,缺乏相关的专门的单行法,这些立法存在一些问题,难以满足发达市场经济实际需求,所以构建产品责任法体系至关重要。本文主要就我国产品责任法体系的构建进行了分析与探讨。
In China, the legal norms related to product liability are “the General Principles of Civil Law of the People’s Republic of China” and the “Law of the People’s Republic of China on Tort Liability”, which lack the relevant special single-line laws. These laws and regulations have some problems that are difficult to meet the actual needs of the developed market economy , So building a system of product liability law is crucial. This article mainly analyzes and discusses the construction of China’s product liability law system.
