“一带一路”发展战略的提出,极大地推动了我国海外投资事业的蓬勃发展。与之相比,相关科研方面和法律制度的建立还较为迟滞,制度与实践之间的不相适应严重阻碍了我国投资者扩展海外投资。文章通过对我国现行海外投资法律制度法律文件、制度体系的分析,指出我国海外投资相关法律文件等在立法和运行层面存在的问题,并为建立健全我国海外投资法律制度提出相应对策,以期促进我国海外投资法律体系趋于完备,推动对外投资事业长远发展。
The proposed “One Belt, One Road” development strategy has greatly promoted the vigorous development of China’s overseas investment. In contrast, the establishment of related scientific research and legal systems is still relatively lagging, and the incompatibility between system and practice seriously hinders the expansion of overseas investment by Chinese investors. By analyzing the legal documents and system of the legal system of overseas investment in our country, the article points out the legislative and operational problems of our legal documents on overseas investment and puts forward corresponding countermeasures for establishing and perfecting the legal system of overseas investment in order to promote our country The legal system of overseas investment tends to be complete and the long-term development of overseas investment is promoted.
