滑稽模仿自身的模仿性、搞笑性、批评性的特征,使得滑稽模仿作品盛行。与此同时,也暴露出了一些问题:部分滑稽模仿的对象是享有著作权保护的作品,当滑稽模仿者在原作品的基础上进行讽刺性、幽默性的模仿时就会对原作品产生一系列的影响。对此,从滑稽模仿的基本理论出发,通过国外立法规定和滑稽模仿的引用程度的分析,肯定滑稽模仿的合法性,并因此提出对我国滑稽模仿在立法上的完善。

At the same time, some problems have also been exposed: some of the objects of parody are the works enjoying the protection of copyrights, and when the parody imitators make mockery and humor imitation on the basis of the original works, they will produce a series of influences. In this regard, starting from the basic theory of parody imitation, the legitimacy of parody imitation is affirmed through the analysis of the foreign legislative provisions and quotations of parody imitation, and thus the legislative perfection of parody imitation in our country is put forward.
