30多年的改革开放实行的是经济改革为中心、以发展为导向的改革历程,在经济发展带给人民很多好处的同时,社会不公的现象也屡见不鲜,十八大以来,中央政府在创新、协调、绿色、开放、共享的五大发展理念下进行了一系列以公平正义为导向的司法体制改革活动,旨在解决经济社会发展中所产生的非预期矛盾。浙江作为民营经济和市民社会运转较为良好的省份,在司法改革过程中结合自身省情提出了“绿色司法”理念,力求从管理体制、司法过程、价值导向等方面为实现整个社会的公平正义提供法制保障。本文将“绿色司法”理念置于国家与社会、政府与市场两重政治关系下考察,试图发掘出“绿色司法”的价值内涵,从而有助于总结浙江经验,指引促进司法公正,助力法治中国建设。
