我国是传统文化深厚、历史悠久的国家。如何加强对传统文化的保护和利用具有重要的研究价值和现实意义。本文以秦皇岛青龙县奚族传统文化为例,探讨了民间传统文化法律保护的思路:利用我国现有保护传统文化的专门法和其他部门法律中的专门条款来实施法律保护,同时协调现有法律法规适用范围和效力等级,在符合国际公约和国际条约立法价值取向的基础上,加快完善我国传统文化法律保护框架体系。
Our country is a country with a profound traditional culture and a long history. How to strengthen the protection and utilization of traditional culture has important research value and practical significance. This article takes the traditional culture of Xi nationality in Qinglong County of Qinhuangdao as an example to discuss the idea of folk traditional culture legal protection: using the existing special laws in our country to protect traditional culture and special provisions in other departmental laws to implement legal protection while coordinating existing laws On the basis of conforming to the value orientation of international conventions and international treaties and based on the scope of application and level of effectiveness of laws and regulations, the framework system for legal protection of traditional culture in China shall be consummated and perfected.
