案例教学法有利于应用型法律职业人才的培养,对于学生法律思维和实务操作能力的提升至关重要,已被广泛地应用到法学教学中。在我国法学教育的教学实践中存在将案例教学法混同于例证教学法、缺少师生互动、受授课教师能力的影响导致教学效果不理想以及选择的教学案例不能满足课程要求这些问题亟待解决,笔者提出教师应正确掌握案例教学法、科学组织教学环节、提高学生案例分析和讨论水平、精心选择高质量的案例等完善方案,以发挥案例教学法在应用型法学人才培养中的作用。
The case teaching method is conducive to the cultivation of applied legal professionals, which is of crucial importance to the improvement of students’ legal thinking and practical ability. It has been widely applied to law teaching. In the teaching practice of law education in our country, there are some problems to be solved, such as the case teaching method is confused with the example teaching method, the lack of interaction between teachers and students, the unsatisfactory teaching effect due to the teaching ability of teachers, and the selected teaching cases can not meet the requirements of the curriculum. It is suggested that teachers should have a correct grasp of the case teaching method, organize the teaching links scientifically, improve the students’ case analysis and discussion level, carefully select high-quality cases and so on, so as to bring the case teaching method into play in the role of applied law legal personnel training.
