美国爆发的次贷危机已演变成部分国家的金融危机和全球性的经济危机,中国经济也受到金融危机的消极影响,很多行业多受到侵蚀,尤其是房地产行业。笔者就金融危机下房地产交易中的定金问题做一个简单介绍,根据合同法司法解释二和相关法律的规定,深入分析房地产交易中的定金问题及相关能够规避房地产交易过程中的法律事实的问题,旨在提出解决此类问题的建设性的意见,减少金融危机下关于房地产中类似问题的盖然性。
The subprime crisis that broke out in the United States has evolved into a financial crisis in some countries and a global economic crisis. The Chinese economy has also been adversely affected by the financial crisis. Many industries have suffered from erosion, especially in the real estate industry. The author gives a brief introduction to the deposit problem in the real estate transaction under the financial crisis. Based on the provisions of the Judicial Interpretation II of the Contract Law and the relevant laws, the author analyzes the deposit problem in the real estate transaction and the related legal issues that can evade the real estate transaction. Aimed at putting forward constructive suggestions to solve such problems and reducing the coverage of similar issues in real estate during the financial crisis.
