随着国家惠农土地政策力度的加大,S镇发生了农户之间、农户与种田大户之间以及村民小组与村委会之间的土地纠纷。作为土地纠纷的主要调解机构,因为面临着防止农户上访的压力,乡镇干部更多地选择了一种极端工具化的纠纷解决模式。实践证明,这种纠纷解决模式无助于从根本上解决问题,反而诱发了纠纷的进一步出现。在一定意义上,土地纠纷的发生具有必然性和制度性的双重诱因。这表明,单纯地推进土地产权建设的思路存在着缺陷。
With the intensification of the state policy of benefiting agricultural land, land disputes among farmers, farmer households and farming households, and between villager groups and village committees occurred in S Town. As the main mediator of land disputes, because of the pressure to prevent petitioners from appealing to farmers, township cadres have chosen to adopt an extremely instrumental dispute resolution mode. Practice has proved that this mode of dispute resolution does not help to fundamentally solve the problem, but rather to induce further disputes. In a certain sense, the occurrence of land disputes has the dual inducement and institutional incentives. This shows that there is a flaw in the idea of simply promoting land property rights.
