随着经济的发展,人类的生活日益变化,日常生活和工作中不免会有这样那样的的问题出现,这时,就有《合同法》的出现,来保障一部分人合法的权益。所谓的不可抗力,在我国《民法通则》上指的是“不能预见、不能避免和不能克服的客观情况。”《合同法》所规定的不可抗力是一种属于强制性的规定,当事人的约定不能够与法律强制性规定相抵触,因此当事人应当在法律规定的原则条件下,列举具体的属于不可抗力的情况。违背法律强制性规定的约定应当无效。合同中的不可抗力不尽相同,在很多责任承担方面也有很多不同的地方。
