本文试图从中国社会主义法治建设的曲折发展过程出发,阐发法治建设的必然性和对和谐社会建设、中华民族伟大复兴中国梦实现的保障作用。提出:法律是治国之重器,良法是善治之前提。理论依据是中国传统德性法治思想。韩非子是中国传统法家文化的代表人物之一,本文通过辩证分析韩非子的“以法制利”思想和“法不阿贵”观点,得出,韩非子的法治思想对当下法治建设提供宝贵思想资源的同时,却忽略并弱化了中国传统道德价值理念的社会保障和行为规范作用。道德建设与法治建设对于社会进步、民族发展来讲,相当于一鸟两翼的作用,缺一不可。理性的法律框架应建立在崇高道德价值理念之上,这样才可以制定出良法,实现社会主义法治建设的良性发展。
This article attempts to set out from the tortuous development process of the legal construction of socialism in China, and elucidates the inevitability of the construction of the rule of law and the safeguarding effect on the construction of a harmonious society and the realization of the Chinese dream of great rejuvenation of the Chinese nation. Put forward: Law is the heavy burden of governing the country, good law is the prerequisite for good governance. The theoretical basis is the traditional Chinese thought of virtue and the rule of law. Han Fei-zi is one of the representative figures of traditional Chinese legal culture. By dialectical analysis of Han Fei-zi’s idea of “law-based interest” and “law-not-arrogant”, it concludes that Han Fei-zi’s thought of the rule of law provides the current legal construction While at the same time ignoring and weakening the social security and normative role of China’s traditional moral values. The construction of morality and the rule of law are indispensable to the progress of society and the development of the nation in terms of the role of one bird and two wings. A rational legal framework should be based on the lofty moral values so that good laws can be worked out to achieve the sound development of the socialist rule of law.
