世纪之交,现代化运动正在中国广泛而深入地进行,教育和法制的现代化无疑是牵动人们视线的两条主线。然而,教育的现代化运动离不开法制的推动,对教育现代化的关注就必然要关注教育法制的现代化。因之,从现代教育与法制的关系出发,全面总结当代中国教育法制建设的历程和经验教训,探索中国教育法制现代化的前景和发展方向,对于更好地推动中国教育的现代化,实现依法治教、科教兴国,丰富中国法制现代化的内容,有着十分重要的时代意义。本文主要从:一、教育法治:中国教育现代化的时代要求;二、当代中国教育法制现代化的进程;三、现代中国教育法制评估;四、中国教育法制现代化的前瞻等四个方面进行初步的探讨。
At the turn of the century, the modernization movement is being carried out extensively and deeply in China. The modernization of education and the legal system is undoubtedly the two main lines that affect people’s attention. However, the modernization movement of education can not be separated from the promotion of the legal system. The concern about the modernization of education must pay attention to the modernization of the education legal system. Therefore, proceeding from the relationship between modern education and legal system, this paper comprehensively summarizes the course and experiences and lessons of the legal education system in contemporary China, and explores the prospects and development directions of the modernization of China’s education legal system. It is of great value in promoting the modernization of education in China and in administering education according to law It is of momentous significance for the times when science and education are rejuvenating the country and enriching the modernization of China’s legal system.
