伴随着国家惠农和扶农政策的深入,农村、农业、农民的自营经济不断发展,农民在融资方面遭遇到瓶颈,既不能像国家工作人员申请信用贷款或住房公积金贷款,也不能像城镇居民办理房屋或土地使用权抵押借款。农民融资只能求亲靠友,利用他人的资产或信用提供担保。如何进一步拓宽融资渠道,激活“沉睡”资产,有效利用农户自有现有资产,解决农户贷款难、担保难问题显得尤为重要,集体土地入市的呼声也越来越迫切,党的十八大三中全会公告:赋予农民更多财产权利,推进城乡要素平等交换和公共资源均衡配置的论述也正面回答了农民的诉求。理解好农村土地所有权、土地使用权、房屋所有权的概念,开展的农村房屋抵押登记业务,为那些急需用钱但又借不到钱的农户及小微企业将会带来便利,也顺应党的大政方针。本文立足于公证实务,从理论与实践两个方面对公证机构开展和办理农村个人私有房屋抵押登记进行了深入探讨,以期引起广大公证同仁的共同关注。
