作为我国法律援助体系的一个重要组成部分,值班律师制度不仅有助于嫌疑人、被告人及时获得律师的法律帮助,有效地行使各项权利,而且突破了法律援助的范围,增加了法律援助案件的数量。但由于该项制度发展时间不长,还存在诸多尚待完善之处,比如值班律师是否应被赋予阅卷权、在检察院是否有必要设立值班律师办公室及未来是否实行电话咨询等。因此本文通过对上述问题进行反思,来达到使值班律师制度更趋完善的目的。
As an important part of legal aid system in our country, duty lawyer system not only helps suspects and defendants get legal help of lawyers timely and effectively, but also breaks through the scope of legal aid and increases legal aid cases quantity. However, due to the fact that this system has not been developed for a long time, there are still many areas that need to be improved, such as whether duty lawyers should be given the right to read the papers, whether it is necessary to establish a duty lawyer’s office in the prosecutor’s office, and whether telephone counseling will be implemented in the future. Therefore, this article through the reflection on the above issues, to achieve on duty lawyer system more perfect purpose.
