彝族婚姻习惯法作为一项地方性知识,与国家婚姻法共同维护着当地的婚姻秩序,彝族婚姻习惯法已经被彝族民众普遍接受并成为其生活准则的重要组成部分。随着社会的发展,彝族婚姻习惯法与国家婚姻法之间存在着种种差异,而要解决国家婚姻法与彝族婚姻习惯法的冲突,必须在维护文化多元的前提下,给予彝族婚姻习惯法充分的认可和尊重,承认彝族婚姻习惯法对于国家婚姻法的补充和协助作用,并最终通过构建两者间的协调机制来实现。
As a local knowledge, the Yi marriage customs law jointly maintains the local marriage order with the National Marriage Law. The Yi marriage customs law has been widely accepted by Yi people and has become an important part of their living standards. With the development of society, there are various differences between the customary law of marriage of the Yi nationality and the national marriage law. To resolve the conflict between the national marriage law and the customary marriage law of the Yi ethnic group, we must give sufficient recognition to the marriage customary law of the Yi ethnic group under the premise of preserving cultural pluralism And to respect and recognize the supplement and assistance of the Yi nationality marriage law to the national marriage law and finally to realize the coordination mechanism between the two.
