在中国法制变革的过程中,始终存在着西方法律精神和中国法律传统的双重影响。中西法律文化的交互影响与共同作用,推动着中国传统法向现代法的过渡和转变。在现代法治演进中,各种思想观念不断碰撞和交流,各种制度不断比较和选择,体现了中国法制现代化的特征——交汇与融合。这是一个连续的、至今没有结束的过程,这也是一个至今仍在发挥作用的法制发展的主旋律。
In the process of legal system reform in China, there is always the double influence of the spirit of western law and the Chinese legal tradition.
