美国法律教育中先后兴起的“案例教学法”、“诊所式法律教学”等基于建构主义的教学方式的核心都是“对话”。建构主义的对话具有开放性、启发性和反思性特征。作为建构主义教学的核心表现形式的是师生对话,对话者具有不同于传统教学模式中的角色扮演及其关系。在法学案例教学中引入并强化“对话”概念可以作为改革我国传统法学教学模式的突破口。
The core of the constructivism-based teaching methods such as “case teaching method” and “clinic-based legal teaching” which have arisen one after another in American law education are all “dialogue”. Constructivist dialogue has an open, enlightening and reflective character. As the core manifestation of constructivism teaching is the dialogue between teachers and students, interlocutor has a different from the role of traditional teaching model and its relationship. The introduction and strengthening of the concept of “dialogue” in jurisprudence teaching can serve as a breakthrough point in reforming the traditional teaching mode of law in our country.
