从科索沃独立,到克里米亚问题和苏格兰公投,延续到争议不断的加泰罗尼亚地区以及英国脱欧后带来的一系列潜在问题,在当代,独立公投作为民族自决权的重要实践方式,得到了国际社会的密切关注,也引发了一系列的国际法争议。在当代,独立公投到底是和平处理民族问题、避免武装冲突的合理方法,还是被民族分裂主义和“新干涉主义”操纵的破坏国家主权的工具。本文希望通过对独立公投的理论基础和全球实践进行研究与分析,对独立公投的国际法现状与发展做一些新的探讨。
From the independence of Kosovo to the issue of Crimea and the referendum in Scotland, to the series of potential problems posed by the continuing controversy in Catalonia and the Brexit by the United Kingdom, the current practice of an independent referendum as an important national self-determination Way, has been the close attention of the international community, also triggered a series of controversies in international law. In the contemporary era, an independent referendum is a reasonable method of peacefully dealing with ethnic issues and avoiding armed conflicts. It is also a tool used by the national separatists and the “new interventionists” to undermine the sovereignty of the country. This article hopes to make some new discussions on the current situation and development of international law in an independent referendum by studying and analyzing the theoretical basis and global practice of the independent referendum.
