目前,各地不动产登记机构对农村村民在原有宅基地上翻建房屋后、土地登记类型如何办理的问题,看法各异。有的地方按首次登记办理,有的地方则按变更登记办理。笔者认为,若从国家有关法律法规以及福建省政府对农村村民住宅建设管理办法有关规定来看,对农宅翻建后其宅基地的登记应按变更登记办理较妥。主要依据及观点如下:从相关适用法规看宅基地使用权登记的类型宅基地使用权首次登记的涵义。目前,法律界尚未对宅基地使用权首次登记给予明确的定
