从知名商品的界定、知名商品名称权与相关权利的冲突、竞争自由与名称保护关系等三个方面来分析这个制度,这个制度存在着诸多局限性。在揭示其局限性中,进一步提出了修订这个制度的一些想法。
This system is analyzed from three aspects: the definition of well-known goods, the conflict between the rights of famous products and the related rights, the relationship between freedom of competition and name protection. There are many limitations in this system. In revealing its limitations, some ideas for revising this system were further proposed.
