自2012年2月15日起施行的《最高人民法院关于国家赔偿案件立案工作的规定》,在总结司法实践经验基础上,依据《国家赔偿法》及其他有关法律规定制定的。其旨在充分保障公民、法人和其他组织依法行使请求国家赔偿的权利,保证人民法院及时、准确审查受理国家赔偿案件,将修改后的《国家赔偿法》加大人权保障力度的精神落到实处。主要具有五大亮点:
