检察机关开展职务犯罪社会化预防工作是从源头遏制职务犯罪的迫切需要,是职务犯罪预防专业化的必然延伸,是构建惩治和预防腐败体系的重要内容。在立法保障方面,应推动当地人大制定地方性法规;在工作机制方面,应探索党委领导下的社会化大预防工作格局;在工作形式方面,应构建形式多样、点面结合的预防工作体系。但当前尚面临检察预防权法定性不足,社会化预防工作机制尚不成熟,专业人才缺乏等问题。对此,应加快预防职务犯罪全国性立法的步伐;强化侦防一体化建设,增强检察机关社会化预防工作的实效;采取多种措施,加强预防专业人才队伍建设。
Procuratorial organs to carry out social crime prevention of job-related crimes is the urgent need to curb crime at the source, is the inevitable extension of the specialization of job-related crime prevention, and an important part of building a system to punish and prevent corruption. In terms of legislative guarantee, the local people’s congress should be encouraged to formulate local laws and regulations; on the working mechanism, the prevention of social work under the leadership of the party committee should be explored; and in terms of the forms of work, various forms of preventive work system combining point and plane should be established. At present, however, we still face the problems of lacking in the legal nature of prosecutorial prevention powers, the immature social protection mechanism and the shortage of professionals. To this end, we should speed up the pace of national legislation to prevent job-related crimes; strengthen the integration of detection and prevention and enhance the effectiveness of procuratorial organs for socialization prevention; and take various measures to strengthen the prevention of the construction of specialized personnel.
