由于没有明确人民法院下达执行通知书的期限,司法实践中,往往出现人民法院的执行通知书不能及时或过早下达的情况,严重损害了刑罚执行的严肃性。笔者建议立法机关完善刑事诉讼法、监狱法的有关规定或最高人民法院、最高人民检察院应尽快制定相关法律或司法解释。
In the absence of a clear deadline for the people’s court to issue a notice of execution, in judicial practice, the situation that the notice of execution by a people’s court often fails to be released in a timely manner or prematurely, seriously impairs the seriousness of the punishment. The author suggests that the legislature should improve the relevant provisions of the Criminal Procedure Law and the Prisons Law or the Supreme People’s Court and the Supreme People’s Procuratorate should make relevant laws or judicial interpretations as soon as possible.
