财产公示的法治化是财产公示制度化、规范化、程序化的必然要求和必然趋势,其根本目的在于方便公众监督和克服单纯的行政内部监督的弊端,让人民群众监督权的行使有法可依,有效地预防腐败,提高行政行为的廉洁指数和行政工作的透明度。根据我国的实际国情,我国宜选择财产公示法治化的统一路径,在法律层面规范财产公示行为,明确财产公示的对象及公示的财产范围,确立财产公示的方式、程序、监督途径及法律责任,使财产公示行为具备行政诉讼法规制的条件,衔接财产公示行为的司法救济渠道,从而全面实现财产公示的法治化。
