我国宪法和《缔结条约程序法》关于主要国家机构条约权力的规定过于宏观和概括,尤其是关于全国人大常委会条约权力的规定有瑕疵、并且内涵不完整。该权力与国务院缔约权的关系不平衡,这已被几十年来的国家条约实践所证明,影响了全国人大常委会作为最高国家权力机关权威的体现和权力的行使。通过对主要国家机构条约权力结构的历史发展进行溯源,总结该结构的现状及特点,可以检讨全国人大常委会条约权力存在的问题,并提出完善该权力的建议。在中国不断扩大对外开放的过程中,完整有力的全国人大常委会条约权力对国家开展对外交往、参与国际事务、推动法治建设将发挥越来越重要的作用。
The provisions of our country’s Constitution and the Treaty of Procedure Procedure Treaty on the powers of treaties of major national institutions are too macroscopic and generalized. In particular, the provisions on the treaty power of the NPC Standing Committee are flawed and the connotation is not complete. The imbalance between this power and the contracting power of the State Council has been proven by the practice of state treaties over the past decades and has affected the exercise of the NPC Standing Committee as the embodiment of the authority of the highest organ of state power and the exercise of power. By tracing the historical development of the treaty power structure of the major state institutions and summarizing the status quo and characteristics of the treaty structure, we can review the existing problems of the treaty power of the NPC Standing Committee and put forward suggestions on how to perfect the power. In the process of China’s continuous opening up to the outside world, the power of treaty power of a complete and powerful NPC Standing Committee will play an increasingly important role in carrying out foreign exchanges, participating in international affairs and promoting the rule of law by the state.
