诈骗罪和盗窃罪是两种多发犯罪,有时它们存在着许多近似的特点。本文通过对案例的分析,得出以下结论:在诈骗行为和盗窃行为交织的时候,可以将“被害人的财产损失是否由其真实意识的处分行为所导致”作为犯罪行为定性的标准之一。
Fraud and theft are two types of multiple crimes and sometimes they have many similarities. Based on the analysis of the case, this paper draws the following conclusion: When the fraud and theft are intertwined, one of the criteria of “whether the property damage of the victim is caused by the action of its true consciousness” can be regarded as one of the criteria of criminalization .
