改革开放三十年来,不仅创造了中国经济发展的奇迹,也是中国近代以来历史上最好的变法图强时期。所谓的变法,更多的是学憭借鉴他国的法律制度。短短三十年,就已初步形成有中国特色的社会主义法律体系。有人称这是一个法律移植时代。回顾一下这个法律移植时代,我们发现移植的不仅仅是法律文本,而且包含法律思想、司法体制、法律文化等等。我们移植的对象不仅来自制定法国家。甚至也来自判例法国家;不仅来自有着古老法律传统的国家,也来自那些移植别国法律较为成功的国家或地区,甚至很多还来自前苏联……。但是同时,中国本土的法制传统 Thirty years of reform and opening up have not only created a miracle in China’s economic development, but also marked the best period in the history of the reform in the history of modern China.
