道德和法律有着严格的区别,主要表现在产生的时间和条件不同,道德比法律规范产生得早,法律仅存在于有阶级的社会中,而道德则在无阶级社会中也存在;表现形式不同,道德是自发形成的,法律则通过具体的、规范的形式表达出来;调整范围不同,道德调整的范围比法律要广泛得多;作用机制不同,道德主要靠社会舆论等非强制形式发挥作用,法律则是国家制定并由国家强制执行的;对人们行为的要求程度不同,道德规范对人们的行为要求比法律规范高。
