日本的不动产登记制度,是以法律的形式要求人们必须遵守的一个制度。这个制度的核心是不动产登记法。日本的不动产登记法,是根据日本的登记法(1886年)和日本的民法(1896),于1899年颁布实施的。经过数十年的不断修改,有的条款甚至是全条修改或增加,以不动产登记法为首,加上相应的政令和省令,至今已经在日本形成了一套完整的不动产登记制度。本文主要参考日本不动产登记法,介绍一下日本的不动产登记制度。一、不动产及登记根据日本民法第86条和日本不动产登记法第14条规定,所谓不动产是指土地和建筑物。
Japan's real estate registration system is a system that people must obey in the form of law. The core of this system is the real property registration law. The Real Estate Registration Act of Japan was promulgated in 1899 according to Japan's Registration Act (1886) and Japan's Civil Law (1896). After decades of continuous revision, some articles even amend or increase the whole article. With the real estate registration law, together with the corresponding government decrees and provincial decree, so far a complete set of real estate registration system has been formed in Japan. This article mainly refers to Japan's Real Estate Registration Act, to introduce Japan's real estate registration system. I.
