2004年8月30日,日本最高裁判所(即法院)宣告:无法采用三井住友信托银行的主张,继续维持东京高等裁判所做出的判断(即判决)。这个判断意味着三菱东京金融集团同日联金融集团之间全面经营合并的计划得以顺利实现,而住友信托银行同日联金融集团的合并谈判彻底“流产”,同时还表明整个日本金融市场,乃至世界金融市场的格局将重新划分。 通过司法程序来解决金融纷争,这在日本金融史上尚属首次。无论这场纷争的最终结果如何,世界上最大的金融集团都将在日本诞生。它的横空出世引起日本金融界甚至国际金融界的深切的关注。
On August 30, 2004, the Supreme Court of Japan (the court) declared that it was unable to adopt the Sumitomo Mitsui Bank’s assertion and maintained the judgment (that is, the judgment) made by the Tokyo High Court. This judgment means that the plan of full-scale merger between Mitsubishi Tokyo Financial Group and UFJ Financial Group has been successfully implemented, and the merger negotiation between Sumitomo Trust and UFJ Financial Group has completely “aborted” and at the same time shows that the entire Japanese financial market and even the world’s financial Market structure will be re-divided. Solving financial disputes through judicial procedures is the first time in Japan’s financial history. Whatever the end result of this dispute, the world’s largest financial conglomerate will be born in Japan. Its emergence turned out to be the deep concern of the Japanese financial community and even the international financial community.
