中国律师资格考试,是一种国家级的职业资格考试。自设立这项考试以来,全国已有60多万人参加了考试,并有10万余人考试合格,取得了律师资格证书。这项考试已成为中国发展律师队伍的主要方式。现将这一考试作一简要介绍。一、律师资格考试的由来 1979年,党中央决定恢复自1957年以后废止的律师制度,全国人大常委会于1980年通过了建国以来第一部关于律师的法律:《律师暂行条例》。该条例第2章规定,担任律师要具备律师资格,取得律师资格须经省、自治区、直辖市司法厅〔局)考核批准。
Chinese lawyer qualification examination is a national vocational qualification examination. Since the establishment of this examination, more than 600,000 people have taken the exams nationwide and have passed the examinations of more than 100,000 people and obtained the qualification certificates of lawyers. This examination has become the main method of developing a lawyer team in China. This exam is now a brief introduction. I. The Origin of Lawyer’s Qualification Examination In 1979, the Central Party Committee decided to resume the lawyer system that was abolished after 1957. The Standing Committee of the National People’s Congress passed the first law on lawyers since its founding in 1980: the Provisional Regulations on Lawyers. Chapter 2 of the Ordinance stipulates that as a lawyer to be qualified as a solicitor, obtaining a lawyer qualification shall be examined and approved by the Judicial Department of the provinces, autonomous regions and municipalities directly under the Central Government.
