劳动合同是劳动者与用人单位确立劳动关系、明确双方权利和义务的协议,依法成立的合同具有法律约束力,双方当事人必须依照合同的规定履行义务。但是,实践中因用人单位未能履行口头许诺及合同中词语模糊等比比皆是。一些用人单位甚至利用自己所处的优势地位,在格式合同中订立一些不公平的条款,而求职者通常不会仔细阅读那些印制精美的合同文件。有时即使读了,但因词语艰涩,模糊不清也很难理解其真意。
The labor contract is an agreement between the laborer and the employer to establish the labor relationship and clarify the rights and obligations of both parties. The contract established according to law is legally binding, and both parties must perform their obligations in accordance with the provisions of the contract. However, in practice, employers failed to fulfill their verbal promises and the words in the contracts were vague. Some employers even make use of their dominant position to establish unfair clauses in the format contracts, and job seekers usually do not read carefully the beautifully printed contract documents. Sometimes even read, but difficult to understand the words, blurred it is difficult to understand the true meaning.
