近年来,建筑施工企业之间所发生的经济纠纷案件较为频繁,在这些纠纷案件之中很多都是由于工程款的拖欠、施工设备租赁款项等引起的纠纷,而很多债权人常常都是以设备租赁合同、购销合同或者加工定做合同等合同纠纷作为案由,在其所在地的法院进行起诉,同时利用合同中的某些违约条款来让自己获得暴利。很多建筑施工企业在这类合同纠纷案件中吃到了哑巴亏,给自身企业带来了巨大的经济损失。而导致这一问题产生的根本原因就在于建筑施工企业在签订合同的过程中缺乏足够的法律知识,也不具有较强的履约意识,本文正是对这一问题进行了大量研究,在文中分析了建筑施工企业法律风险的几个特点,并结合实际工作经验,提出了如何防范法律风险特别是合同风险的几点措施。
