目前,我国对不起诉裁量权的监督制约主要体现在检察机关的内部监督,公安机关、被害人、被不起诉人、人民法院的制约以及人民监督员对自侦案件的监督制约。有必要通过建立不起诉听证制度,增强不起诉裁量权适用的公开民主性;明确相对不起诉决定的效力,防止公诉机关再行起诉;建立书面化指令机制,规范上级检察官的监督机制;完善检察机关内部监督制约的启动方式;构建法院对不起诉决定的审查机制;限制被害人滥用自诉权,维护不起诉决定的稳定性;确保人民监督员监督的独立性,增强监督的效力等途径和方式进行制度完善。
