行政强制是行政法上的一项基本的制度,作为一种手段它在行政管理过程中被广泛使用。然而,理论上对此问题的研究较为混乱,制度实践也表现出诸多困扰和冲突。为应对这种现实,2011年6月30日,《中华人民共和国行政强制法》在历经12年四次审议后,由十一届全国人大常委会第二十一次会议通过,并于2012年1月1日起施行。此法的出台弥补了以前行政强制制度的散、乱、软的问题,但在实践中如何做到尽善尽美仍然是亟待解决的问题。
Administrative coercion is a basic system in administrative law. As a measure, it is widely used in the process of administration. However, in theory, the study of this issue is rather chaotic, and institutional practice also shows many troubles and conflicts. To cope with this reality, on June 30, 2011, the “Administrative Compulsion Law of the People’s Republic of China” was adopted at the Twenty-first Meeting of the Standing Committee of the Eleventh National People’s Congress after four deliberations in 12 years and in 2012 January 1 will come into effect. The promulgation of this law makes up for the scattered, chaotic and soft issues of the previous administrative coercive system. However, it is still an urgent solution to how to be perfect in practice.
