本文从越南投资矿产领域的基本法律环境入手,分析了越南现有的一般法律体系和中越经贸协议体系。介绍了越南投资矿产相关法律和政策内容,包含投资法、矿产法、企业法。分析了现有政策下投资越南矿产领域的利弊,并就投资可能涉及到的法律风险进行简单提示。剖析了越南现有法律对投资矿产项目的便利之处和不足之处。最后从作好投资可行性研究、充分考虑投资成本、避免单一矿产开采或简单加工项目、审批手续由越南当地合作方办理等四方面法律建议。
This article starts with the basic legal environment of Vietnam’s investment in mineral field and analyzes the existing general legal system in Vietnam and the Sino-Vietnam economic and trade agreement system. Introduced the relevant law and policy of investment in mineral products in Vietnam, including investment law, mineral law and business law. Analyzes the pros and cons of investing in the field of mineral products in Vietnam under the existing policies and provides simple clues on the legal risks that may be involved in the investment. It analyzes the advantages and disadvantages of the existing laws of Vietnam on investment in mineral projects. Finally, from the investment feasibility study, give full consideration to investment costs, to avoid single mining or simple processing projects, approval procedures by Vietnamese local partners and other legal advice from four aspects.
