商事活动的开展以商事信用的建立为前提,健全的商事信用制度对商事交易发展具有促进作用。营业执照制度,是我国保障商事信用的重要制度。但由于立法的混乱以及对营业执照的功能定位错误,其在实际中和理论上存在很大的困境,本文拟探讨通过建立商行为能力公示制度的方式,为商事信用制度的完善找到突破口。
Commercial activities carried out on the premise of the establishment of commercial credit, a sound commercial credit system to promote the development of commercial transactions. Business license system is an important system of commercial credit protection in our country. However, due to the confusion of legislation and the wrong orientation of the function of the business license, it has great plight in practice and in theory. This article intends to explore ways to improve the commercial credit system through the establishment of a system of commercial capacity announcement.
