深圳经济特区的法律地位是指深圳经济特区在我国行政管理系统中属何层次,在对外开放中居何地位、享有哪些自主权以及与广东省、全国的关系如何.香港特别行政区的法律地位是指香港特别行政区在国家政权结构中的地位,即特别行政区与中央的关系如何,享有何等程度的自治权等.通过比较,知其异同,以便深港两地互相借鉴、合作互补、共创繁荣.这对于”九七”香港回归祖国,实现深圳与香港顺利衔接具有一定的现实意义.一、关于两个区域的性质深圳经济特区是中国五个特区之一,在地理上,与香港毗邻,而在法律上,深圳与香港却是两个性质完全不同的区域.我国《宪法》第30条第1款规定:“中华人民共和国的行政区域划分如下:(1)全国分为省、自治区、直辖市;(2)省、自治区分为自治州、县、自治县、市;(3)县、自治县分为乡、民族乡、镇.”从该条规定看,我国宪法并没有将经济特区作为一个层次的行政区域予以确定.因此,深圳经济特区并非特别行政区,它是中华人民共和国领土的一部分,由中华人民共和国政府对其行使国家主权,受中国共产党的领导,其主要立法、司法和行政管理权,均由我国权力机关和行政机关所掌握,其经济活动是在社会主义经济领导下进行的.与我国内地其他地区一样,深圳经济特区也要坚持四项基本原则,坚
