宅基地使用权是保障农民基本居住权的一种用益物权,具有较强的福利性质和社会保障功能。根据物权法原理,宅基地使用权的取得方式包括原始取得和继受取得。目前,原始取得一般指申请取得,继受取得的主要形式是转让,而现有法律法规关于申请取得和转让的规定存在诸多疏漏,不能适应社会经济发展的要求,应该从明确界定申请取得的主体,强化集体经济组织的权利,放开对宅基地使用权流转的限制等方面加以完善。
