由于假定垄断者测试本身“以价格为核心的单边市场逻辑”的限制,SSNIP测试在网络市场语境下界定相关商品市场遇到了若干困境,结合网络市场的网络外部性以及双边市场的特点,本文从奇虎360诉腾讯滥用市场支配地位纠纷案出发,首先通过质疑一审判决的判决理由以及在界定相关产品市场时适用SSNIP测试的合理性:其次在驳论后立论,阐述在界定相关产品市场时不具备适用SSNIP测试前提的理由:网络效应、双边市场和平台整合性,揭示出在网络反垄断案件中界定相关产品市场的困境;最后针对困境,论证SSNIP测试的修正思路,主张摆脱以价格为核心转而采用以性价一体化为核心的评价体系。
