《社区矫正法(征求意见稿)》(以下称《征求意见稿》)虽然有很多内容可圈可点,但也存在以下四方面的问题:第一,关于社区矫正性质。《征求意见稿》没有规定社区矫正性质,建议明确规定社区矫正的刑罚执行性质。第二,关于危险管理。危险管理能够有效保障社区及公众安全,为保障社区及公众安全,建议规定危险管理制度。第三,关于教育与帮扶。为了使教育与帮扶工作因人而异,建议规定矫正需要评估与矫正项目制度。第四,关于强制权规定。为了提高社区矫正机构对服刑人员的管控能力,建议授予社区矫正机构对服刑人员予以准监禁的权力。
