《天坛宪草》作为一种法律文化现象,在中国制宪史上有着举足轻重的作用。但是宪法学界对它的关注程度却难尽如人意,对于《天坛宪草》失败的主要原因以往持有“袁世凯个人干预”、“政治力量斗争的结果”、“政治人物的政治精神守旧”以及“政治权术不成熟”等几种观点。本文通过对其在何种意义上失败的分析以及对传统观点的反思与评价,结合民国初期政治社会化的历史现实,重新对《天坛宪草》失败的主要原因予以定位。
As a phenomenon of legal culture, “Temple of Heaven, Constitution and Constitution” plays a decisive role in the constitutional history of China. However, the degree of attention paid by the constitutional scholarship to it is far from satisfactory. In the past, the main reason for the failure of the “Temple of Heaven” held “the personal intervention of Yuan Shikai”, “the result of the struggle for political power”, and “ Conservative political spirit ”and“ political and political immaturity ”and other views. In this paper, I analyze the main reasons for the failure of the “Temple of Heaven” through the analysis of its failure in the sense and its reflection on and evaluation of the traditional viewpoints, combined with the historical reality of political socialization in the early Republic of China.
